Collin County District Attorney Greg Willis has responded to allegations made by Mike Howard, the lead defense attorney for Karmelo Anthony, who was convicted of murdering Austin Metcalf and sentenced to 35 years in prison.
Howard's affidavit, part of Anthony's appeal, claims that prosecutors violated a supposed "gentlemen's agreement" regarding character evidence and that a crucial hearing was conducted too quickly, which impaired the defense's preparation.
Willis contends that court transcripts obtained by CBS News Texas contradict many assertions made by Howard. He remarked that the claims do not align with what transpired in court. During a private discussion about Anthony's potential testimony, Howard admitted that the agreement was honored, while Judge John Roach Jr. noted that he would not uphold informal agreements in a criminal trial.
Howard's affidavit indicates he believed Anthony would testify but alleges that the judge restricted their preparation time. However, the transcript shows that the judge thoroughly explained Anthony's rights and allowed more than 30 minutes for the defense to deliberate, during which Anthony consulted with his parents before opting not to testify.
Willis expressed his surprise and disappointment regarding Howard's claims, defending the prosecution's actions as fair and professional. Howard has not replied to requests for comment and will not be involved in the upcoming appeal process. Willis believes the appeal will likely not succeed, asserting confidence in the integrity of the prosecution's conduct.
The first hearing related to the appeal may take place as soon as next month.
